Terms & Conditions of Sale

  1. GENERAL
    Acceptance of these terms and conditions is signified and implied by the customer ordering goods.
  2. ORDERS & CONFIRMATIONS
    Placing Orders
    Please quote your account number when placing orders. All orders must be place in writing either by post, fax (01233 730 942) or email sales@designforum.co.uk. Alternatively, you may place orders through agents and distributors

    Confirmations
    When you place a curtain order with us we will send you confirmation of your Order by e-mail/fax/letter.
    We reserve the right to charge for any subsequent changes necessary as a result of your failure to properly check the order confirmation

  3. FABRIC PIECE PRICE
    An additional discount of 5% is available to account holders for full pieces over 40 metres in length.
  4. SAMPLES
    Cuttings
    Cuttings of all our fabrics will be sent either to the account address or directly to the customer free of charge. The average size of the cuttings will be approximately 10cm x 12cm. If you require a closer colour match, please request a stock cutting.

    Website
    Every care has been taken to describe and illustrate fabrics and items accurately using current photographic technology, but slight variations in actual goods may occur. We strongly recommend that you request a sample prior to ordering to check colour and texture.

    Returnable Samples
    These are available and roughly 70cm x 50cm. Account customers may take these on a 30-day loan. If not returned their account will be charged at £10.00 + VAT. Non-account holders may order these at £10 each refundable on return.

  5. DELIVERIES
    Cut Lengths: We will always endeavour to deliver to customers required schedule. A courier company undertakes our deliveries and Design Forum cannot be held liable if a delivery has been delayed. All delivery times are subject to stock availability. Delays will be notified either by phone or in writing.

    Where deliveries are made to third parties (curtain-makers, upholsterers, decorators etc) on the instructions of customer, it is the responsibility of the customer to ensure that the correct material is received. We advise that a sample is sent to a third party to enable verification when the goods are received.

    In the case of reversible fabrics, please indicate the correct face. We can accept no claims for any make-up or installation charges or replacement, where goods have not been verified.

    Custom Made: Your Order will take approximately 3-4 weeks from the date shown on the order confirmation to be ready.
    A 2-week delivery service is available at an additional 15% on your order.

  6. DELIVERY CHARGES
    UK – Mainland

    Standard Service: 1 – 3 days £10.50
    These costs are up to 20 kg – Please note excess weight will be charged at costCustom Made
    Standard Service: 3-4 weeks £20.00

    Premium Service: Guaranteed Next Day before noon £25.00
    Saturday Delivery before noon £40.00 (up to 20kg)
    These prices are exclusive of VAT.

    All other carriage costs on application.

  7. RETURNED GOODS
    Cut Lengths: Returns will be accepted for credit provided they have not been cut or damaged, and providing they are returned within 7 days of invoice date. A 25% handling fee will be levied, plus any carriage costs.

    Please contact our sales department to arrange collection. A collection note will be forwarded to you. Please enclose this with the goods, including the reason for return, along with the relevant invoice or sales order number. Credit notes cannot be issued until the goods are returned.

  8. CUSTOM MADE
    We have the right to correct faults if the goods are not received to your specification. Please notify us within 7 days of receipt of goods in writing. Credits/refunds will only be made in cases where goods have not been used, fitted and every reasonable care taken.
  9. FAULTY GOODS
    Fabrics should be carefully inspected prior to cutting. Whilst every effort is made to control and inspect each order to ensure you receive the fabric in the best possible condition, faults can occur, damaged and creasing can occur in transit and therefore it is essential that no length is cut until you are totally satisfied in all respects. Check that the correct fabric has been sent.
  10. TREATMENTS
    No liability will be accepted for changes in appearance, performance or defects in any of our fabrics if they are treated, after purchase, by spraying or processing of any kind, including flameproofing or the applications of stain-repelling treatments.
  11. FLAME PROOFING
    Flameproofing can be carried out on most of our fabrics. Please note that flameproofing often affects the finish, handle and occasionally the colour of the fabrics. We will accept no liability as a result of changes to the fabric due to any treatments. Carriage on flameproofing will be charged at £35.00 ex VAT per order. This is due to an outbound and inbound carriage.

    All treatments whether back coating, pyrovatex or any other for usage on curtains or upholstery will be charged at £3.50 per metre. There is a minimum charge of £20.00 per piece if under 5 meters. Please check with office for suitability on different fabrics with different treatments. For standards in European countries please apply for cost as these often need to be sent to the country of end usage for treatment.

  12. CLIMATE & HUMIDITY
    Some fabrics can be affected by changes in climate and/or humidity. These are natural occurrences and are not caused by faults in the fabrics. We accept no liability for any changes due to climate and/or humidity.
  13. CLEANING
    We cannot guarantee against shrinkage or colour discolouration due to washing or contact with any liquid. Please allow approximately 5% shrinkage during cleaning processes.
  14. COLOUR MATCHING
    There can be a slight shade difference between samples and different batches. If exact colour match required we recommend that stock cuttings be requested. We cannot guarantee that after time our fabrics will not fade.
  15. PATTERN REPEATS
    All measurements for repeats and widths are approximate. Allow up to 5% for variances in pattern repeats. Where extra cuts are required due to variances the customer will be liable to pay for these in full.
  16. VELVETS
    Even when velvets are packed properly during transportation some crushing or shining aspect may appear on the fabric but this should not be considered faulty. When velvet is used for upholstery some variation may appear this is to be considered normal and may disappear with time. Contact with water may permanently alter the appearance of the velvet.
  17. LIMITED STOCK
    These are designs that are discontinued but still available from stock. Please check stocks before ordering for availability.
  18. TRADE DISCOUNTS
    Trade discounts are available to bone-fide Trade Customers. Please apply to head office with completed new account form. Credit accounts will be created at the discretion of Design Forum.
  19. DISPLAY DISCOUNTS
    Are available please apply to the office.
  20. MANUFACTURING
    Design Forum maintains the right to alter or change the manufacturing origin or process for any of its fabrics. This may in turn alter the appearance of the design.
  21. LIABILITY
    We supply all goods on condition that our liability for any fault or defect in the quality, condition, description or fitness for any purpose is limited in amount to a sum not exceeding the purchase price of any particular goods. In no circumstances whatsoever shall the company be liable for indirect or consequential loss or damage.
  22. TITLE
    Title to, and ownership of the relevant goods remain the absolute and unencumbered property of Design Forum until payment in full is received.
  23. PAYMENT TERMS
    Our terms are strictly net monthly; all accounts are payable within 30 days. Accounts may be placed on stop if it becomes overdue. Credit card payments will incur a surcharge of 2.5%. Interest will be added to any outstanding accounts over 30 days late.
